I understand the death penalty why its there all that so don't start in on that its just a question.
Is the Exp loss on death intended to be a relatively equal punishment regardless of level?

Is the Exp loss on death intended to be a relatively equal punishment regardless of level? I don't know if you could call it equal since it's 3% regardless of level. So it will sting a bit more for higher levels since 3% of xp at epic level is big.

the important word there is relatively equal (ie should it hurt as much at level 20 as it did at level 10 ((apx same number of kills to recover the loss at the same risk factor?)))

To add to this, I've noticed something that appears to be happening with ECL races.
ECL +1 seem to lose 200 XP at level 1. ECL +2 lose 300 XP at level 1. I haven't heard any reports from the ECL +3 losing more, but they probably never die anyway. ;D
Is this intentional?
Also, the Myrkul conversation still says PCs will lose 5% XP last I heard.

I died and went to the fugue plan. I talked to myrkul and asked to go back to my corpse. to my surprise I didn't and lost 100 xp. I had to return back to the tavern and lost additional xp. didn't see this bug posted anywhere and my apologies if it has.

400xp death at level 1 for deep gnome.
Going into some little crypt in the underdark was a bad idea. Not only did I make it through the crypt completely without anymore than a healing potion, but once I made it through, every trap had been reset and seemed to do much more damage. I got hit by an acid trap on a door for about 35 damage after I made my save (level 2 mind you).
Also someone made a camp fire which kills you instantly if you click on it =\
Well, to make a long story short, a little exploring in a crypt with no monsters and no loot (minus a scroll of mage armor) and a misclick on a campfire ended up losing me 2k exp and deleveling back to level 1 in about 15 minutes. When you need 6k exp for level 2, being set back another 2k isn't much fun.

Deep gnomes being +3 ECL get treated as level 4 when they die, so therefore you get the level 4 XP penalty. The campfire that was trapped is part of the bugged trap script which appears to be trapping random objects. It's supposed to be fixed soon from what I hear.

As plainly as possible. There is utterly no fear of death on this server for me. Dying is a couple hour's worth of setback at the most, and ill usually get it back just sitting around talking.
A couple times ive seen players level -twice- on the walk from Baldur's Gate to Beregost. People act like grouping with other players is a bother, even though that is what D&D IS. I mean why play this game when tactically it is inferior to WoW in nearly every way as an action game? I know its RP light here, but I would either like to see less XP or harsher death penalties.
I like the idea of level loss on death after level 4. My favorite death penalty setup is actually an increasing scale where you loose 100 per level until 4, then 1 level until 8, and 2 from then on. Raise dead and Ressurection halve the penalty, and True Res has no penalty. PnP has a level loss of 1 for being raised or ressurected.
I like harsh death penalties and quick XP gain because it keeps from stagnation but it also introduces the fear of death. When you know you've got two levels riding on a fight, you are going to approach situations much more carefully and be more prone to finding comrades to help out.
I know this probably won't be popular, its just my opinion.

Laurk, if we were to implement that and losing those lvls put you under the lvl req for an item you have equipped... is there any potential for bugged characters?
Do you know if the server you played on had lvl reqs for items enforced?
Otherwise I wouldnt really be opposed to it I suppose. It would sure make people more likely to wait around for a res or raise! Losing 2 lvls at 20th lvl would sting like all hells but I suppose it should for an epic character, eh?
All that said.. i bet that doesnt happen.

as you level up, that xp dosnt seem to come as fast as it did earlyer, so sometimes, you will feel it. and to those that feel like they gain xp to fast/ level up... stop grinding then, and spend the time RP. some people dont have so much time to play, and it porberly wont be so fun for them, if they want to gain a level. it will take them all the time they got for gamin, 6 month for that level. i dont have so much time now, after i startet on school, for gaming. and il get even less time, soon. and if you lose to muhc dying. it will make people less likely, to try harder ares/go explore. not all of us know how hard the varius mobs are
